1. Acceptance of Terms

By accessing or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you disagree with any part of these terms, then you may not access the Service. These Terms apply to all visitors, users, and others who access or use the Service.

2. Description of Service

Coco Polls is a Slack application that enables users to create, manage, and participate in polls and surveys within their Slack workspace. The Service allows you to create various types of polls, collect responses from team members, and view results in real-time.

3. Use of Service

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to:

• Use the Service in any way that violates any applicable law or regulation
• Use the Service to transmit any malicious code, viruses, or harmful materials
• Attempt to gain unauthorized access to any portion of the Service
• Interfere with or disrupt the Service or servers connected to the Service
• Use the Service to collect or store personal data about other users without their express consent
• Create polls containing offensive, discriminatory, or inappropriate content
• Impersonate or misrepresent your affiliation with any person or entity

You are responsible for all content you create, including polls, responses, and any other materials you submit through the Service.

4. Accounts and Registration

To access certain features of the Service, you must connect your Slack workspace and authorize the Coco Polls application. When you create an account or connect your workspace, you must provide information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account.

You are responsible for safeguarding any authentication tokens and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

5. Intellectual Property

The Service and its original content, features, and functionality are and will remain the exclusive property of Coco Polls and its licensors. The Service is protected by copyright, trademark, and other laws. Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent.

You retain ownership of any content you create through the Service, including polls and responses. By using the Service, you grant us a worldwide, non-exclusive, royalty-free license to use, store, and display your content solely for the purpose of providing and improving the Service.

6. Subscriptions and Payments

Some features of the Service may require a paid subscription. By purchasing a subscription, you agree to pay the fees specified at the time of purchase. Subscription fees are billed in advance on a monthly or annual basis, as selected by you. You may cancel your subscription at any time, and your cancellation will take effect at the end of the current billing period.

We reserve the right to change our pricing with 30 days' notice. Price changes will apply to subsequent billing periods.

7. Refund Policy

For now, all subscription fees and payments made to Coco Polls are final and non-refundable. By purchasing a subscription, you acknowledge that you have read and understood this refund policy and agree that no refunds will be provided for any reason, including but not limited to:

• Dissatisfaction with the Service
• Unused subscription time
• Cancellation of your subscription
• Termination of your account
• Changes to Service features or functionality
• Downgrades or upgrades to your subscription plan

If you cancel your subscription, you will continue to have access to paid features until the end of your current billing period. No refunds will be issued for the remaining unused portion of your subscription period.

This refund policy applies to all subscription plans, add-on services, and any other paid features unless otherwise explicitly stated in writing by Coco Polls. We reserve the right to modify this refund policy at any time, and any changes will be effective for purchases made after the policy update. This policy is subject to applicable laws and regulations in your jurisdiction, and nothing in this policy limits any rights you may have under consumer protection laws.

8. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the Service will immediately cease.

If you wish to terminate your account, you may do so by disconnecting the Coco Polls application from your Slack workspace or by contacting us. All provisions of the Terms that by their nature should survive termination shall survive termination, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

9. Limitation of Liability

In no event shall Coco Polls, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

• Your access to or use of or inability to access or use the Service
• Any conduct or content of third parties on the Service
• Any content obtained from the Service
• Unauthorized access, use, or alteration of your transmissions or content

Our total liability to you for all claims arising out of or relating to the use of or any inability to use any portion of the Service shall not exceed the amount you paid us in the twelve months prior to the action giving rise to liability.

10. Disclaimer

The Service is provided on an "as is" and "as available" basis. We make no warranties, expressed or implied, and hereby disclaim and negate all other warranties, including without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights.

11. Indemnification

You agree to defend, indemnify, and hold harmless Coco Polls and its licensee and licensors, and their employees, contractors, agents, officers and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees).

12. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Service.

13. Governing Law

These Terms shall be interpreted and governed by the laws of the jurisdiction in which we operate, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
